Individual author royalties paid after 100 copies purchased from or sold by the Publisher. Royalties will be paid as follows: $1.50/book sold at retail, (children's book is different) $.50/book sold at wholesale. Royalties are paid quarterly.
Publisher Rights and entitlements:
1. Exclusive right to produce, publish, and market the book beginning with the acceptance of online terms and contract and continuing in perpetuity or at such time that publisher relinquishes said rights.
2. Right to reprint or update as necessary with the primary author given first chance to write the revision/update.
3. Legal indemnification for issues relating to plagiarism or unauthorized author use of existing copyrighted materials by the author.
4. Right to set and change the retail price of the book.
5. Right to nullify and void contract at author’s request and upon publisher acceptance of terms of the agreement for a fee of not less than $5000.00 and with a 30-day written notice to Chaplain Publishing, LLC.
6. Right to out-source any or all aspects of book production.
7. Right to sell publishing rights to a third party while maintianing author royalties.
8. Right to refuse to publish any manuscript deemed by publisher as inappropriate or contrary to the values and mission of Chaplain Publishing, LLC.
9. Right to void and terminate contract as may be dictated by necessity and with 30-day notice to the author.
Contract
This agreement is between Chaplain Publishing, LLC and the author of the manuscript submitted for publication. It becomes binding with the return of the author information form from the Chaplain Publishing website. This agreement will remain in effect until terminated by either party as set forth in this agreement. Author and Publisher are bound by all conditions set forth in the above section entitled "Terms and Conditions," as well as all sections listed under Section I License, below.
I. License
a. author is not entitled to any publishing rights or copyright licenses to the manuscript or any other material submitted by the author to the publisher relating to the manuscript commencing on the first day of acceptance of the terms set forth in this contract. Section I. (a) applies only to those books assigned an ISBN from Chaplain Publishing.
b. publisher will produce a softback book version of the manuscript within a reasonable time frame depending on the amount of work needed to bring the manuscript to a camera-ready copy.
c. author grants publisher an exclusive license to distribute and sell author's manuscript and all other material submitted to the publisher by the author in print or digital form. Publisher rights continue in perpetuity or at such time publisher relinquishes said rights.
d. author grants publisher the right to exhibit the book in part on websites owned by the publisher or other book selling venues for the purpose of marketing and selling of the book product.
e. author grants publisher the right to print, display, or distribute any and all related materials submitted in conjunction with the manuscript, which includes, but is not limited to: cover art, interior and exterior images, concepts, photographs (including author's), author's biography, testimonials, etc.
f. author agrees to select a publishing package from the publisher's website and pay the associated costs prior to the commencing of book printing, if costs are applicable to the selected option.
g. publisher retains the right to refuse to publish at any time and for any reason.
h. author represents and warrants that author is the sole owner of the manuscript and all submitted material for publication. Author represents and warrants that author has full authority to enter into this agreement, and is at least 18 years of age.
II. Disclaimer
Chaplain Publishing, LLC, makes no guarantee, implicit or explict, that the book or print product produced under this agreement will be accepted for worldwide distribution by Ingram Distributors, Spring Arbor Distributors, Barnes and Noble Stores, or any other book store or retail or wholesale outlet referred to in this document. Chaplain Publishing does promise to submit the book product for distribution to any or all of the aforementioned on behalf of the author, for inclusion in their respective distribution programs.
